The regulatory measures of generative artificial intelligence are more "symptomatic" and leave room for development.

  CCTV News:On April 11th, the National Internet Information Office began to solicit opinions from the public on the Administrative Measures for Generative Artificial Intelligence Services (Draft for Comment). According to experts’ analysis, the Draft for Comment puts forward multi-level supervision opinions, emphasizes the protection of rights and interests, and prevents "abuse" behavior, which contributes to the healthy development of generative artificial intelligence technology in China.

  There are 21 articles in the Exposure Draft, which defines "generative artificial intelligence" as a technology that generates text, pictures, sounds, videos, codes and other contents based on algorithms, models and rules, and clarifies that "the state supports independent innovation, popularization and application, and international cooperation of basic technologies such as artificial intelligence algorithms and frameworks, and encourages the priority use of safe and reliable software, tools, calculation and data resources".

  According to the "Exposure Draft", the provision of generative artificial intelligence products or services should comply with the requirements of laws and regulations, respect social morality, public order and good customs, and prohibit illegal acquisition, disclosure and use of personal information, privacy and trade secrets. Before using generative artificial intelligence products to provide services to the public, it is necessary to report to the national network information department for safety assessment, and be responsible for the legality of the pre-training data of generative artificial intelligence products and the source of optimized training data. Pre-training and optimized training data for generative artificial intelligence products shall comply with the requirements of laws and regulations, and shall not contain any content infringing intellectual property rights. If the data contains personal information, it shall obtain the consent of the subject of personal information, and ensure the authenticity, accuracy, objectivity and diversity of the data.

  On the user side, the user should be required to provide real identity information in accordance with the regulations, and the service should be suspended or terminated if violations of laws and regulations, business ethics and social ethics are found, including engaging in online speculation, malicious posting and comments, creating spam, writing malicious software, and implementing unfair business marketing.

  With the hot market of ChatGPT, the public’s awareness of generative artificial intelligence technology is constantly improving. Up to now, China Internet companies such as Baidu, Huawei, Tencent, Ali, JD.COM and 360 have deployed generative artificial intelligence services. The rapid development of technology has put forward higher requirements for regulators and business ecology, and also brought greater challenges.

  According to industry insiders, the publication of the "Draft for Comment" means that the pace of standardization in the AI industry is accelerating. While delineating the boundaries, it also leaves ample room for development and is committed to avoiding the dilemma of "pollution first and then governance". With more applications landing, some potential risks will be recognized and exposed, and the regulatory measures will be more "symptomatic". The Draft for Comment is only the first step.
